Terms and Conditions:


These are the terms and conditions ("Consumer Terms and Conditions") which govern your purchase of Hilton gift vouchers (“Gift Vouchers”) via the website located at https://hiltonhotels.skchase.com/ (the “Website”).
The Website is managed and operated by SK Chase Limited ("SK Chase", “we”, “us”, “our”) in its role as a service provider to Hilton Worldwide Limited (“Hilton”).  It is SK Chase who will collect payments from you.  SK Chase is a company incorporated in Scotland (No SC253912) with its registered office at 31 Palmerston Place, Edinburgh, EH12 5AP.


By using the Website, you confirm that you accept and agree to comply with these Consumer Terms and Conditions and the terms and conditions of use of any Gift Vouchers you purchase (as listed on the relevant product page(s) of the Website) ("Gift Voucher Terms of Use"). If you do not accept these Consumer Terms and Conditions you must not use the Website.  Failure to comply with these Consumer Terms and Conditions or the Gift Voucher Terms of Use after purchase may mean that the relevant Gift Voucher(s) will not be redeemable.


You will be asked to agree to these Consumer Terms and Conditions before placing an order. We recommend that you print a copy of these Consumer Terms and Conditions and the Gift Voucher Terms of Use that apply to any orders you make for future reference.


SK Chase and Hilton reserve the right to vary these Consumer Terms and Conditions and the Gift Voucher Terms of Use from time to time (see clause 9 for further details).
Because you are a consumer, we are under a legal duty to supply products that are in conformity with our contract with you. You also have legal rights under consumer protection legislation in relation to products that are faulty or misdescribed.  Nothing in these Consumer Terms and Conditions or the Gift Voucher Terms of Use alter or affect your statutory rights (including your right to receive a refund for faulty or misdescribed Gift Vouchers).  Advice about your legal rights, including your rights to cancel the contract, is available from your local Citizens Advice Bureau or Trading Standards office.


1. Purchase


1.1 The Website offers Gift Vouchers for sale.  All prices on the Website are inclusive of VAT (where applicable).


1.2 No contract for the sale of any Gift Voucher will subsist between you and us unless and until your order is accepted by way of an email (issued by SK Chase) detailing that payment has been received in full, the content of the Gift Voucher(s) purchased and confirming your details (the "Confirmation"). That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time SK Chase sends the Confirmation to you (whether or not you receive that Confirmation). The Confirmation amounts to an acceptance by us of your offer to buy the Gift Voucher(s).  In the event of any inconsistency or conflict between these Consumer Terms and Conditions and the Confirmation or the details on the relevant product page(s) of the Website (including the Gift Voucher Terms of Use) these Consumer Terms and Conditions shall prevail to the extent of the conflict or inconsistency.


1.3 You must check that the details of the Confirmation are correct as soon as possible and you should print out and keep a copy of it.


1.4 If purchasing a Gift Voucher through the Website or on the telephone, payment shall be taken by SK Chase by credit or debit card. You can make payments with the following cards: Mastercard, Visa, Delta, American Express, Switch or Solo).  Please note that any payments deducted by SK Chase from your account or refunded back to you will appear on your statement as being from SK Chase.


1.5 You undertake that all details you provide to SK Chase and Hilton for the purpose of ordering any Gift Voucher(s) are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the Gift Voucher(s) ordered.


1.6 In order to protect your details during ordering, the Website uses a software package known as Secured Sockets Layer (SSL), which is indicated by a padlock which will appear in the bottom left hand corner of the web browser (grey border area of the screen).


2. Issuing Gift Vouchers 

   
2.1 Once your order for a Gift Voucher has been processed by SK Chase, SK Chase shall be responsible for issuing the Gift Voucher by e-mailing it to you (where available) or posting it to you first class (or special delivery, airmail or international signed for if requested) as per your selection during the ordering process and performing any other terms set out in the Confirmation. Please allow seven (7) days for UK delivery during peak postal time.  There is no dispatch or delivery on UK bank holidays or weekends.  Please note that postal delivery is by Royal Mail therefore neither SK Chase nor Hilton can be held responsible for delays caused by the postal system.  Neither SK Chase nor Hilton accept liability for any delay which may occur in the delivery times which are due to circumstances outside their control.  You may cancel an order in such circumstances by contacting SK Chase via the contact details set out in clause 5.1.


2.2 Please note that postage and packaging charges are not included in the Gift Voucher prices.  Any postage and packaging charges which apply are advised to you during the check-out and ordering process before you confirm your order.  The following supplements will apply:


Email - £0.00
UK First Class - from £3.13 to £3.53
Airmail - from £4.12 to £6.40
UK Special Delivery - from £8.65 to £9.05
International Signed-For - from £9.80 to £12.50


2.3 Orders delivered by post will be dispatched in accordance with the following timescale:


•    For orders placed on a working day (Monday - Friday, excluding bank holidays) before 12 noon (UK time), the order will be dispatched the same day.  
•    For orders placed on a working day after 12 noon (UK time) or on a weekend day, the order will be dispatched the next working day.


2.4 The following postal delivery options are available to customers ordering from the UK:


(1)    UK first class delivery - standard Royal Mail UK first class delivery service.  Please then allow five (5) working days for the Gift Voucher(s) to be delivered by Royal Mail.  Please note that UK first class post does not guarantee delivery within above timescales, and cannot be traced if it goes missing.
(2)    UK Special delivery - standard Royal Mail UK Special delivery.  This will be tracked by Royal Mail and requires a signature from the recipient.  Special Delivery guarantees receipt of the Gift Voucher(s) by 1pm on the next working day (not weekends).  Please make sure that you (or the recipient) are available to sign for the delivery otherwise it will be returned to the sorting office for collection. Please note that if you place an order on a Friday before 12 noon, Royal Mail will not guarantee delivery on Saturday but will guarantee delivery by Monday.
(3)    Airmail - standard Royal Mail Airmail delivery. This should be selected for any overseas Gift Voucher orders.
(4)     International Signed For - standard Royal Mail Recorded Overseas delivery. As with UK Special delivery the delivery is recorded and a signature is required upon delivery.  If you use International Signed For with Airmail delivery, Royal Mail has a target time of within five (5) working days to Western Europe, six (6) working days to Eastern Europe and seven (7) working days for the rest of the world. By surface mail, it may take up to two (2) weeks for Western Europe, four (4) weeks for Eastern Europe, and up to eight (8) weeks elsewhere.  If your item is not delivered, please allow up to twenty five (25) days after posting before you consider it lost.  This is because your item may have been held in customs or be in the process of being returned to sender if it could not be delivered for some reason.


2.5 On some occasions where SK Chase has dispatched your Gift Voucher order it gets lost in the post.  If you have not received your order five (5) days after placing the order (or twenty five (25) days in the case of International Signed For delivery), please contact SK Chase via the contact details set out in clause 5.1.  SK Chase may need to cancel your original order and issue you with new Gift Voucher.  In this situation you should destroy the original Gift Voucher if it is eventually received as it will no longer be valid.


2.6 In relation to delivery of Gift Vouchers via email (where available) an automatic email with a Gift Voucher link will be sent within one (1) hour of the transaction being completed. This can be sent to either the purchaser or the recipient of the Gift Voucher(s).  This is a system generated email and therefore may go to the email recipient's junk or spam email folder. Please also take care when entering an email address that it is correct. If an email delivery fails we will attempt to contact you to advise that the email has been returned to us 'undelivered' and will try to get another email address. 3.  Gift Voucher Redemption


3.1 Please remember that, in addition to the terms included in these Consumer Terms and Conditions, the Gift Voucher Terms of Use apply.  Note that they are individual to each Gift Voucher and can be viewed on the Website on the product page for each Gift Voucher.


3.2 All specific arrangements regarding booking dates and times must be made directly with the hotel, and you should reconfirm any arrangements made with the hotel a few days before the event to avoid disappointment. The hotel will use all reasonable endeavours to meet your request but cannot guarantee any specific date or time.


4.  Cancellations


4.1 The provisions in clauses 4.2-4.5 will apply in respect of all Gift Vouchers, unless: (a) the Gift Voucher is for the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities and the voucher provides for a specific date or period of performance; or (b) the Gift Voucher has been redeemed, in which case the Gift Voucher is non-refundable and non-transferable unless otherwise agreed by Hilton.


4.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your Gift Voucher order starting from the date that SK Chase sends you the Confirmation (which is when the contract is formed with us), until either: (a) 14 days from the day after the day of receipt of your Gift Voucher if your contract is for one Gift Voucher; or (b) 14 days from the day after the day of receipt of the last of the Gift Vouchers ordered if your contract is for multiple Gift Vouchers which are delivered on separate days (the "Cancellation Period").


4.3 If you wish to cancel your order either before or after you receive the Gift Voucher(s), you must notify SK Chase within the Cancellation Period that you have decided to cancel the contract.  The easiest way to do this is to contact SK Chase in accordance with clause 5.1 or you may use the cancellation form which can be accessed by clicking here which you can fill out and return to SK Chase by email.   If you decide to cancel by email, with or without the cancellation form, your cancellation will be effective from the date you send SK Chase the email.


4.4 If you cancel the contract within the Cancellation Period in accordance with clause 4.3, SK Chase will refund you the price you have paid for the Gift Voucher(s) within 14 days after the day on which SK Chase receives the notice of cancellation from you (irrespective or not of whether you have received the Gift Voucher(s).)


4.5 If the postal delivery option was chosen, refunds provided by SK Chase under clause 4.4 will include the outbound delivery cost, unless you chose to have the Gift Voucher(s) delivered by more expensive means than the cheapest standard delivery option offered to you.  In such cases the full outbound delivery cost will not be refunded, but we will refund the cost of the cheapest standard delivery option which you could have chosen (usually UK first class post). If you have already received the Gift Voucher which you have cancelled, you should destroy it.  If SK Chase finds that, after it has received your notice of cancellation, that the Gift Voucher has been used, you shall not be entitled to a refund.  


4.6 Your right to cancel in the event that we or Hilton modify these Consumer Terms and Conditions or the Gift Voucher Terms of Use as they apply to your order is set out at clause 9.2.

6. Liability


6.1 This section applies only to the extent permitted by law. For the avoidance of doubt, SK Chase and Hilton do not exclude or limit any liability for (a) personal injury (including sickness) or death where this results from the negligence or wilful default of SK Chase or Hilton, or that of their employees, agents or subcontractors or (b) fraud or fraudulent misrepresentation.


6.2 In the event that SK Chase or Hilton breach these Consumer Terms and Conditions or the Gift Voucher Terms of Use, they shall be responsible only for refunding the cost of the Gift Voucher to you. SK Chase and Hilton shall not be liable to pay any other compensation or losses suffered by you as a consequence of their breach.


6.3 The hotel  agrees to provide the services for which the Gift Voucher was purchased in accordance with the description on the Website and the www.hilton.com website (if applicable), at all times with reasonable skill and care. The hotel makes no other warranty or representation.


7. Copyright


The Website is protected by copyright, and other intellectual property rights and laws. You may view the Website and download part(s) of it to a personal computer for personal viewing for private purposes, but for no other purpose whatsoever. NONE OF THE CONTENT MAY BE DOWNLOADED, COPIED, REPRODUCED, TRANSMITTED, STORED, SOLD OR DISTRIBUTED FOR ANY NON PERSONAL PURPOSE WITHOUT OUR PRIOR WRITTEN CONSENT.


8. Disclaimer


By accessing and using the Website, or any of the information on it, you acknowledge that, while reasonable endeavours have been used to ensure that all information contained on the Website is correct, accurate and up to date, neither SK Chase nor Hilton make any warranties, representations or undertakings that the material on the Website will be free from infections, viruses, worms, trojan horses and/or other codes that have contaminating or destructive properties. It is your responsibility to take protective steps such as having virus checking software installed on your device.


9.  Modifications


9.1 SK Chase and Hilton reserve the right to vary these Consumer Terms and Conditions and the Gift Voucher Terms of Use from time to time. It is your responsibility to regularly review these Consumer Terms and Conditions and the Gift Voucher Terms of Use to keep up to date with any changes to them.  Any changes to the Gift Voucher Terms of Use that apply to a particular Gift Voucher will be listed on the relevant product page of the Website.


9.2 If we need to revise these Consumer Terms and Conditions or the Gift Voucher Terms of Use as they apply to your order, we will contact you to give you reasonable advance notice of the changes and to let you know how to cancel the order if you are not happy with the changes.  If you opt to cancel and you have ordered more than one Gift Voucher, you can cancel in respect of one Gift Voucher or all of the Gift Vouchers. After receipt of your notice of cancellation, SK Chase will arrange a full refund of the price you have paid, which shall include any delivery charges if you have selected the postal option for delivery (irrespective of whether you have already received the Gift Voucher).  If you have already received the Gift Voucher which you have cancelled, you should destroy it.   


10. General provisions


10.1 If SK Chase or Hilton fail to insist that you perform any of your obligations under these Consumer Terms and Conditions or the Gift Voucher Terms of Use, or if they do not enforce their rights against you, or if they delay in doing so, that will not mean that they have waived their rights against you and will not mean that you do not have to comply with those obligations. If they do waive a default by you, they will only do so in writing, and that will not mean that they will automatically waive any later default by you.


10.2 Neither SK Chase nor Hilton will be liable or responsible for any failure to perform, or delay in performance of, any of their obligations under these Consumer Terms and Conditions or the Gift Voucher Terms of Use that is caused by an event outside their control.  An "event outside their control" means any act or event beyond their reasonable control, including but not limited to strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack,war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.


10.3 Each of the paragraphs of these Consumer Terms and Conditions and the Gift Voucher Terms of Use operates separately. If any paragraph is found to be unlawful by a court of competent jurisdiction or other relevant authority, you agree that the other paragraphs will remain in full force and effect in so far as possible.


10.4 SK Chase and Hilton may transfer their rights under these Consumer Terms and Conditions and the Gift Voucher Terms of Use to another organisation, but this will not affect your rights or their obligations under the respective documents.


10.5 For the avoidance of doubt, Hilton and its subsidiary and holding companies are intended third party beneficiaries of these Consumer Terms and Conditions and may enforce their provisions as if they were a party to them.


10.6 If you access the Website from outside the UK you are responsible for compliance with any local laws relating to access.


11. Governing Law and Jurisdiction


The Website, the Gift Vouchers, the Gift Voucher Terms of Use and these Consumer Terms and Conditions are governed by the laws of Scotland and you can bring legal proceedings in respect of all matters relating to them in the courts of Scotland. If you live in England or Wales you can bring such legal proceedings in either the courts of Scotland or the courts of England and Wales. If you live in Northern Ireland you can bring such legal proceedings in either the courts of Scotland or the courts of Northern Ireland.
